Terms of Use — Pollenly

By downloading or using Pollenly (the "App"), you agree to these Terms of Use. If you don't agree, please don't use the App. Apple's standard Licensed Application End User License Agreement also applies alongside these Terms.

1. Not medical advice — important

Pollenly provides general, informational guidance to help you plan around pollen. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Pollen forecasts and symptom insights are estimates and may be inaccurate or incomplete. Never rely on the App for medical decisions. Always consult a qualified doctor or pharmacist about symptoms, medication, or any health concern, and call your local emergency number for urgent or breathing-related symptoms.

2. Forecast data

Pollen, weather, and air-quality information comes from third-party providers (including Google, Open-Meteo, and Atmospore). We don't control this data and don't guarantee its accuracy, availability, or coverage — which varies by region (hourly and species-level detail is strongest in Europe). Data may be delayed, estimated, or unavailable.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use, subject to these Terms and the App Store's terms.

4. Acceptable use

You agree not to: reverse-engineer, decompile, or tamper with the App except as permitted by law; use it unlawfully; or attempt to disrupt or misuse the third-party services it relies on.

5. Your content

Anything you log in the diary is stored on your device and remains yours. See the Privacy Policy for how data is handled.

6. Intellectual property

The App, its design, name, and content (excluding third-party data) are owned by BS Studio and protected by applicable laws. These Terms grant you no ownership rights.

7. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by law, BS Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the App or reliance on its information. Where liability cannot be excluded, it is limited to the amount you paid for the App (if any) in the 12 months before the claim.

9. Changes

We may update the App or these Terms. Continued use after changes means you accept the updated Terms; the "Last updated" date will change.

10. Termination

You may stop using the App at any time by deleting it. We may suspend or end the license if you breach these Terms.

11. Governing law

These Terms are governed by the laws applicable to your place of residence, without prejudice to any mandatory consumer-protection rights available to you locally.
